- alec baldwin sues his own production crew for negligence
what happened based upon what has been reported:
'rust' was based on a true story
the filming took place just north of sante fe, new mexico on the bonanza creek ranch, which has thousands of acres and 5 movie set 'towns' and has had a number of popular movies film there
filming began october 6th
the film was on it's 12th day of filming and had been planned to be completed in 21 days
the shooting occured on october 21st
the 911 calls about a shooting at the 'rust' movie set came in at 1:50 pm
rev (quoting sheriff mendoza):
sheriff's deputies were dispatched to the bonanza creek ranch at 1:48 pm and arrived at 2:00 pm - ems arrived at 2:01 pm
alec baldwin was sitting on a pew in the church, drew the gun after he explained he was going to draw the gun to the crew, and pointed it at the camera, where the crew were trying to get out of a shadow
alec baldwin was practicing cross drawing the gun across his body
npr:
an affidavit says that alec baldwin was sitting on a pew, practicing how to draw the gun and aim it at the camera
alec baldwin drew the gun one time from the holster then returned it, then when he did it again the gun fired
assistant director david halls yelled 'cold gun !' before handing the gun to alec baldwin
a 'cold gun' is when all of the chambers in the gun are empty
koat tv:
the type of gun was a f.lli pietta long colt 45 revolver, which was designed in 1873
pietta is an italian armament manufacturer that made replicas of the 1873 colt 45 'peacemaker'
the pistol that fired the fatal shot had 'misfired' before
the gun was not a prop gun it was a working firearm that could load real bullets
prop guns are usually made out of pot metal and are not supposed to be able to fire real bullets
armorers say prop guns are not real guns and do not fire bullets
rust armorer hannah gutierrez reed's attorney, jason bowles, said she put 6 'dummy' rounds from a box labelled 'dummy rounds' into the gun before she took her lunch break and there is evidence including a box labelled 'dummy rounds' but containing live rounds left on the set that imply someone committed sabotage
'rust' armorer hannah gutierrez reed loaded the gun with 'dummy' cartridges just before lunch then placed 'socks' over them to keep passersby from picking them up
after the shooting assistant director david halls brought the gun over to the armorer hannah gutierrez reed and they checked the cylinder and david halls said he saw 4 'dummy' rounds and one spent shell casing
- what happened to whatever was in the 6th chamber ? -
cnbc:
the armorer hannah gutierrez reed said that when the crew broke for lunch before filming the scene, the guns to be used for filming were locked in a safe inside the prop truck, but the ammunition was left unsecured on the cart in front of the church
after the guns were prepped and placed on a tray in front of the church they were left unattended for up to two hours
the guns were left unattended for 5 to 10 minutes before the shooting
after lunch, the prop master, sarah zachry, took the 3 guns to be used for filming that day out of the locked prop truck and handed them to the armorer, hannah gutierrez reed, who placed them on a cart outside of the church, where assistant director david halls picked up the gun that fired the bullet, brought it into the church, yelled out 'cold gun' and handed it to alec baldwin
david halls said the armorer, hannah gutierrez reed, opened the gun for him to inspect but that he may not have seen all of the rounds inside the weapon
assistant producer david halls said when the armorer hannah gutierrez reed spun the cylinder of the gun he only saw 3 rounds...
why were there - any - rounds inside a cold gun ?
armorer hannah gutierrez reed reportedly committed unsafe practices on the set of a nicolas cage movie
the 'rust' assistant director david halls also worked on the set of 'the crow: salvation' movie sequel of 'the crow', where brandon lee was killed by a prop gun during the sequel's filming
hannah gutierrez reed was both the armor and assistant prop master ('two really big jobs') on the set of 'rust'
seth kenney was 'the armorer mentor' on the 'rust' movie set, owns a gun shop, had recommended armorer hannah gutierrez reed and supplied the guns on the set
seth kenney's gun shop, 'pdq arm and prop' in lake havasu city, arizona, was started in 2016 after he worked the large movie prop company called 'hand prop room' in los angelas for a number of years
six members of the film crew walked off the set hours before the shooting after alec baldwin's stunt double accidently discharged a gun twice, with a colleague texting the unit production manager that there had been 3 'accidental discharges' of firearms on the set
7 crew members walked off the set
there were two 'accidental discharges' of a firearm on the set on saturday, october 16th
all of the 'accidental discharges' were blanks that inappropriately were fired
the shooting took place shortly after the cast and crew returned from lunch at 12:30 pm on thursday, october 21st
lunch -began- at 12:30 pm and the shooting happened at 1:48 pm
the crew broke for lunch at 12:30 pm
cnbc news:
assistant producer david halls picked up the gun after the shooting, which was sitting on a pew
after the shooting assistant director david halls said: '"Let's clear everyone who doesn't need to be here out of here,"
time:
armorer hannah gutierrez reed removed a shell casing from the gun after the shooting
the armorer hannah gutierrez reed and the assistant director david halls opened the cylinder of the pistol after the shooting and found the remaining ammunition inside the cylinder were dummy rounds which have a small hole drilled into the side of the shell casing and one empty shell casing that did not have a hole
police found 9 spent shell casings on the 'rust' movie set
calls came into the sante fe 911 call center at 1:50 pm thursday, october 21st from the movie set
[did they wait an hour to call 911?]
here's what was said after the shooting
alec baldwin, anjul nigam, matt delpiano, nathan klingher, ryan smith and ryan winterstern are the credited producers for the movie 'rust'
'bondit media company' was named as a financier of 'rust' but without an equity stake in the movie
the 'rust' movie was not bonded, which is like a special insurance on top of regular insurance, in case a film isn't finished on time and under budget - but 'rust' was insured by a company called 'chubb'
'Rust, for example, has seven production and financier companies listed: Thomasville, Baldwin's El Dorado Pictures, Cavalry Media, Brittany House Pictures, Short Porch Pictures, as well as financial backers BondIt Media Capital and Streamline Global.
That’s one of the reasons it’s been difficult to discern who from the mishmash of collaborators, production companies, and financiers attached to the Western was responsible for putting the movie together. '
the name of the 'rust' movie production company is 'rust movie productions'
the 5 producers budgeted $25,000 for hotel rooms for themselves and $95,200 for hotel rooms for 21 line crew members
halyna hutchins' widowed husband matthew hires brian panish and the law firm of panish, shea, boyle, ravipudi llp who won a $billion + settlement for wildfire victims this year for a possible wrongful death case involving the 'rust' movie set shooting
halyna supported the iatse labor union and had planned to strike against the poor working conditions, low pay and long hours film crews across the u s have been facing
the iatse labor union representing the 'rust' crew that walked off the set just before shooting, had made a tentative deal with the major theatrical studios on october 16th, just 5 days before the shooting
halyna hutchins was a member of the international cinematographers guild
assistant director david halls was not a member of the directors guild of America, he was what is called a financial core non member, which meant he resigned his membership or chose not to join in the first place
screen actors guild members consider people with fi cor status as anti-union
one of the 'rust' production companies did not pay non union movie crew on an earlier production
'rust' camera team head lane luper, who walked off of the set, comes forward to tell what he saw
rust crew were all from new mexico
the guardian december 1st, 2021:
'Investigators say that the armourer on the film, Hannah Gutierrez Reed, loaded the gun with five dummy rounds, but struggled to add a sixth before a lunch break, when the revolver was locked in a truck. The final round was added after lunch when the gun was cleaned.'
'Investigators initially found 500 rounds of ammunition at the movie set on the outskirts of Santa Fe: a mix of blanks, dummy rounds and what appeared to be live rounds. Industry experts have said live rounds should never be on set.'
los angelas times january 12, 2022 :
'A box of ammunition, which surfaced on the set near Santa Fe on the morning of the fatal Oct. 21 accident, was labeled “dummies” even though the box contained seven live rounds mixed in with 43 dummies, according to the suit.'
'"PDQ Arm & Prop, LLC provided the guns, Blanks and a portion of Dummy Rounds to Rust,” Kenney said in a statement provided to The Times in late November. “Consistent with the safe industry standards, PDQ did not provide Live Ammunition to Rust.”'
los angelas times january 12, 2022 :
'In her lawsuit, Gutierrez Reed said she did not hand Baldwin the weapon after the lunch break, as is the usual practice, saying she was unaware the gun was going to be used in a rehearsal.
Instead, she presented the gun to Halls, who told investigators he did not check all the rounds in the gun before it was handed to Baldwin.'
'cold guns' are guns with the chambers empty:
